List of SNPs of RK mandatory for use. State register of codes of practice

The Ministry of Justice of the Russian Federation decided not to consider SNiPs for their state registration. Therefore, from April 28, 2006, all SNiPs returned their status of mandatory application. Three years and four months of non-mandatory SNiPs did not lead to anything good: both customers and contractors were left alone with each other, without quantitative and qualitative criteria and standards.

This was especially dangerous in capital construction, where SNiPs are already lagging behind new materials, technologies and methods of interaction. What and how to build, what materials and technologies to use? Novelty and avant-garde in construction are no longer limited to reliability and durability. In the practice of modern construction and under the action of SNiPs, there was enough marriage, and with the restriction and abolition of most norms and rules in construction, permissiveness could come on the one hand, and distrust on the other. Therefore, administrative decisions to leave construction sites without SNiPs could have negative macroeconomic consequences.

With regard to microeconomics, to which repair and construction services for finishing apartments can rightly be attributed, normative nihilism would only ruin the already weak sprouts normative culture finishers and inexperienced customers.

Thus, until the entry into force of the relevant technical regulations, SNiPs are mandatory for use.

In accordance with Article 5 of Federal Law N 384-FZ "Technical Regulations on the Safety of Buildings and Structures", the safety of buildings and structures must be ensured by means of complying with the Federal Law and the requirements of standards and sets of rules, which are included in:

The list of national standards and joint ventures, as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law, approved by the order of the Government of the Russian Federation of June 21, 2010 N1047-r, is ensured;

The list of documents in the field of standardization, as a result of which, on a voluntary basis, compliance with the requirements of the Federal Law, approved by the order of Rostekhregulirovanie dated June 1, 2010 N2079, is ensured. Updated SNIPs that were not included in the above Lists are documents of voluntary use.

The Ministry of Regional Development of Russia, by its Order N 447 of October 14, 2010, determined the contractor for the production and distribution of codes of practice. They became the "Federal Center for Rationing, Standardization and Technical Conformity Assessment in Construction" (FAU "FCS").

In accordance with paragraph 31 of the Rules for the development and approval of sets of rules approved by Decree of the Government of the Russian Federation of November 19, 2008 N 858: “References to sets of rules in the developed and applied documentation are made only if there are officially published copies of sets of rules. Officially published sets of rules are the publications of the FAA "FCS". FAA "FTsS" in close cooperation with the Ministry of Regional Development of the Russian Federation, developers, Rosstandart, TK 465 are obliged to coordinate all work on updating SNiP.

on the application of a list of national standards and sets of rules (parts of such standards and sets of rules), as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures", approved by the Decree of the Government of the Russian Federation of December 26, 2014, is ensured. 1. These Methodological Recommendations have been prepared in accordance with paragraph 3 of Decree of the Government of the Russian Federation dated December 26, 2014 No. 1521 “On Approval of the List of National Standards and Codes of Rules (parts of such standards and codes of rules), as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures" (hereinafter referred to as the resolution, list) and determine the rules for applying the list when performing engineering surveys, carrying out architectural and construction design, construction, conducting an examination of engineering surveys, project documentation, implementation of state construction supervision, as well as supervision at the stage of operation of facilities capital construction.

2. The provisions set out in these methodological recommendations, are recommended for use by organizations and enterprises, regardless of departmental affiliation, forms of ownership and sources of construction financing.

3. The Decree defines a list of documents in the field of standardization (their parts), the requirements of which must be observed when performing engineering surveys, architectural and structural design, construction, operation and demolition of capital construction projects.

4. The provisions of the documents in the field of standardization included in the list are not mandatory in relation to the following buildings and structures up to their reconstruction or overhaul:

to buildings and structures, construction, reconstruction and overhaul which are carried out in accordance with the design documentation approved or submitted for examination before July 1, 2015;

to buildings and structures, in respect of the design documentation of which an examination is not carried out and an application for issuing a building permit for which was submitted before July 1, 2015.

5. In the event that the provisions of the documents in the field of standardization (their parts) included in the list establish the requirement to undergo administrative procedures during the performance of engineering surveys, the implementation of architectural and construction design, construction, operation, demolition of a capital construction facility, administrative procedures not provided for by regulatory legal acts Russian Federation, such a requirement of the document in the field of standardization (its part) does not apply.

The administrative procedure should be understood as a method of interaction between the developer (technical customer) or a person authorized by him (performer of a specific type of work) and state authorities, local governments, other bodies or organizations performing the functions of these persons, organizations participating in the provision of state or municipal services , organizations communal complex, electric grid and gas supply companies in order to perform legally significant actions, including those related to the provision by the developer (technical customer) or a person authorized by him of documents and (or) payment of a fee.

When performing administrative procedures in the field of housing construction, one should be guided by the Decree of the Government of the Russian Federation dated April 30, 2014 No. 403 “On an exhaustive list of procedures in the field of housing construction”.

6. Changes made to the documents included in the list in the field of standardization (their part) in the process of their updating, in accordance with the legislation of the Russian Federation on technical regulation, are applied on a voluntary basis.

Such changes will be applied on a mandatory basis only after the list has been amended.

When making changes to the list, along with the main name of the document, its edition is indicated.

7. If the requirement contained in the document included in the list in the field of standardization (its part) is formulated as a recommendation (there is an indication of the need to comply with the requirement with the words “as a rule”, “with appropriate justification”, “in case of special need ”, “mainly”, “recommended”, “preferred”, “may”, “in necessary cases” and the like), the decision to fulfill such a requirement is made by the developer (technical customer) or a person authorized by him (executor of a specific type of work).

8. Documents in the field of standardization (their parts), which are referenced in the codes of practice and national standards (their parts) included in the list, are applied on a mandatory basis only if these documents (their parts) are contained in the list.

9. From the date of entry into force of the list, documents in the field of standardization that are not included in the list, containing requirements for buildings and structures (the networks of engineering and technical support and systems of engineering support included in them), as well as processes related to buildings and structures design (including surveys), construction, installation, adjustment, operation and disposal (demolition) are applied on a voluntary basis.

10. Annexes to documents in the field of standardization included in the list are applied on a mandatory basis only if the specified annexes are included in the list.

Document overview

A new list of national standards and sets of rules (their parts) was approved, as a result of which, on a mandatory basis, compliance with the requirements of the technical regulations on the safety of buildings and structures is ensured. It will come into effect on July 1, 2015.

It is established how this list is applied.

Thus, the requirements of the documents in the list in the field of standardization (their parts) must be observed during engineering surveys, architectural and construction design, construction, operation and demolition of capital construction facilities. However, they are not mandatory for the following buildings and structures. Firstly, those put into operation before July 1, 2015. Secondly, those whose construction, reconstruction and overhaul are carried out in accordance with the project documentation approved or submitted for examination before the specified date. Thirdly, buildings and structures, in respect of the design documentation of which the examination is not carried out and the application for the issuance of a building permit for which was submitted before July 1, 2015.

If the documents from the list establish a requirement to undergo administrative procedures during the above works that are not provided for Russian legislation, it is not executed.

Changes that are made to the documents from the list are applied on a voluntary basis. Such amendments will become binding only after the amendments to the list.

If the requirement of the document included in the list is advisory, it is up to the developer (technical customer) or a person authorized by him (executor of a specific type of work) to fulfill it or not.

Documents in the field of standardization (parts thereof), which are referred to by the codes of practice and national standards, are used in without fail only if they are on the list.

Annexes to the documents included in the list are executed on a mandatory basis according to the same principle. They should be on the list.

Clause 1 of Article 6 of the Technical Regulations on the Safety of Buildings and Structures states that the Government of the Russian Federation approves a list of national standards and sets of rules (parts of such standards and sets of rules), as a result of which, on a mandatory basis, compliance with the requirements of the Technical Regulations on the Safety of Buildings and structures.

Decree of the Government of the Russian Federation of June 21, 2010 N 1047-r approved the List of National Standards and Codes of Rules (parts of such standards and codes of rules), as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures" ( hereinafter - List N 1047-p).

Decree of the Government of the Russian Federation of December 26, 2014 N 1521 adopted a new List of national standards and sets of rules (parts of such standards and sets of rules), as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures" (hereinafter - List N 1521). The new list, in contrast to the List N 1047-p, containing references to SNiPs, contains references to the joint venture (updated editions of SNiP). Also, some GOSTs and SNiPs were removed from the new List and newly introduced ones were added.

Instead of the List of documents in the field of standardization, as a result of which, on a voluntary basis, compliance with the requirements of the Federal Law of December 30, 2009 N 384-FZ "Technical Regulations on the Safety of Buildings and Structures" is ensured (approved by order of Rostekhregulirovaniya of June 1, 2010 N 2079) On July 1, 2015, the List of documents in the field of standardization came into force, as a result of which, on a voluntary basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures" (approved by Order of Rosstandart dated March 30, 2015 N 365) is ensured.

Attention! From July 1, 2015, List N 1521 should be applied, approved by Decree of the Government of the Russian Federation of December 26, 2014 N 1521 The project documentation and (or) engineering survey results accepted by the developer or technical customer, the development of which began before July 1, 2015 and which are submitted for primary or repeated state or non-state examination of project documentation and (or) engineering survey results, are checked for compliance with national standards and sets of rules (parts of such standards and sets of rules) included in the list approved by order of the Government of the Russian Federation dated June 21, 2010 N 1047-r. In accordance with Decree of the Government of the Russian Federation of September 29, 2015 N 1033, the design documentation and (or) results of engineering surveys accepted by the developer or technical customer, the development of which began in the period from July 1, 2015 before the entry into force of this Decree and which are submitted for primary or repeated state or non-state examination of project documentation and (or) results of engineering surveys are checked for compliance with national standards and codes of practice (parts of such standards and codes of rules) included in the list of national standards and codes of practice (parts of such standards and codes of rules), as a result the application of which on a mandatory basis ensures compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures", approved by Decree of the Government of the Russian Federation of December 26, 2014 N 1521 "On Approval of the List of National Standards and Codes of Rules (parts such standards and codes of practice), as a result of which, on a mandatory basis, compliance with the requirements of the Federal Law "Technical Regulations on the Safety of Buildings and Structures" is ensured, without taking into account the changes approved by this Decree.

Evidence base of the Technical Regulations on the safety of buildings and structures
